Terms of service

1. General provisions

1.1. These online store terms and conditions (the "Terms") are a legally binding document for the Buyer and the Seller that sets out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend or supplement these Terms at any time. The Buyer is informed of any changes to the Terms on the online store website.

2. Conclusion of the sales contract

2.1. The sales contract between the Buyer and the Seller is deemed concluded when the Buyer, having read these Terms, creates and submits an order in the online store.

3. Rights of the Seller

3.1. In the event of important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability or security of the online store or breaches their obligations, the Seller has the right to restrict or suspend the Buyer's access to the online store without warning.

4. Obligations of the Seller

4.1. The Seller undertakes to enable the use of the online store services under the conditions set out in these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, in accordance with the conditions set out in these Terms.
4.3. If, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online store, the Seller has the right to terminate the sales contract after informing the Buyer. The Seller may offer an equivalent product. If the Buyer declines, the Seller undertakes to refund the amount paid within 3 business days.
4.4. If the Buyer exercises the right provided in clause 5.2 of these Terms, the Seller undertakes to refund the amount paid by the Buyer within 5 (five) business days from the date the returned goods are received.
4.5. The Seller may withhold the refund until the goods have been returned to the Seller or until the Buyer provides proof that the goods have been sent back to the Seller, whichever occurs first.

5. Rights of the Buyer

5.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from a sales contract concluded in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer may exercise the right described in clause 5.2 only if the goods have not been damaged, their appearance has not changed significantly and they have not been used.

6. Obligations of the Buyer

6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure set out in these Terms.
6.2. If the Buyer refuses to accept the goods upon delivery without a valid reason, the Buyer must, at the Seller's request, cover the costs of returning the goods.
6.3. Upon delivery, the Buyer must check the condition of the parcel and the goods together with the Seller or the person delivering the parcel.
6.4. By using the online store, the Buyer confirms that they agree to these Terms and undertakes to comply with them.

7. Prices

7.1. Prices in the online store are shown in euros and include VAT. Once the order is confirmed, any applicable delivery charge is added to the total amount.

8. Ordering and payment

8.1. When visiting the online store, the Buyer selects the desired goods and adds them to the shopping cart. After completing the cart, the Buyer enters the personal details required to fulfil the order: first name, last name, delivery address, phone number and any additional information that may be important for delivery. The Buyer confirms that they have read these Terms and confirms the order.
8.3. Payment can be made by payment card (Visa, Mastercard, Maestro, American Express), Apple Pay, Google Pay, Klarna and other methods shown at checkout, as well as through the online banking of Swedbank, SEB, Luminor, Citadele, Coop Pank, Revolut, Artea and N26 via the MakeCommerce payment platform. Payments are accepted in euros.

9. Delivery

9.1. When ordering, the Buyer must provide the exact delivery address.
9.2. The Buyer must accept the goods in person. If the Buyer cannot accept the goods in person, but the goods have been delivered to the address provided by the Buyer, the Buyer has no right to make claims regarding delivery to the wrong person.
9.3. The Seller delivers the goods to the Buyer within the time limits stated in the product descriptions.
9.4. The features of all goods sold are stated in each product's description. The Seller is not responsible if the colour, shape or other parameters of the goods shown in the online store do not match the actual size, shape and colour of the goods due to the characteristics of the Buyer's monitor.
9.5. If the Buyer withdraws from the sales contract, all amounts paid by the Buyer are refunded, including the delivery costs paid by the Buyer.

10. Returns

10.1. Goods of proper quality may be returned within 14 days from the date of receipt. Boats and paddles made to the Buyer's individual order (according to parameters chosen by the Buyer) cannot be returned or exchanged – the right of withdrawal under clause 5.2 does not apply to them (see section 2 of the Refund Policy). Defects of goods of improper quality are remedied, and such goods are replaced or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. The following conditions must be met when returning goods:
10.2.1. The returned item must be in its original, undamaged packaging (this does not apply when returning defective goods);
10.2.2. The item must not have been damaged by the Buyer;
10.2.3. The item must be unused and must not have lost its commercial appearance: labels intact, protective films not removed, etc. (this does not apply when returning defective goods);
10.2.4. The returned item must be complete, as received by the Buyer (this does not apply when returning defective goods);
10.2.5. The Seller has the right to refuse to accept returned goods if the return conditions have not been met;
10.2.6. Goods are returned in the manner specified by the Seller within 14 (fourteen) days from the date of receipt (this does not apply to defective goods, which are returned within the statutory warranty period);
10.3. Goods of proper quality are returned and exchanged in accordance with Article 6.22810(1) of the Civil Code;
